RELEASE AND HOLD HARMLESS AGREEMENT
In regard to the sale, purchase, and use of the STE Incorporated Exhaust System Component Kit (“the kit”):
STE Incorporated (“the seller”) and ___________________ (“the purchaser”), enter into the following agreement:
1. The purchaser covenants not to sue the seller, and agrees to release, indemnify and hold the seller harmless, with regard to any and all liability which could potentially arise as a result of operation or performance of the kit subsequent to the date of this agreement by any and all persons. The purchaser acknowledges and understands the scope, nature and extent of the risks associated with the installation and use of the kit, and freely and voluntarily chooses to assume and incur these risks. By and through this agreement the purchaser forfeits any and all future causes of action that he or she might have against the seller based upon acts or omissions which could be construed as negligent, or any actions based upon liability arising from the use or operation of the kit.
2. The purchaser and the seller agree that the kit is being sold on an “AS IS” basis, and the seller hereby disclaims each and every express, implied or other warranty relating to the operation of the kit, and further specifically disclaims any warranty whatsoever relating to airworthiness of the kit.
